Terms of Service & Billing

These Terms govern your access to and use of Linkza, a micro-SaaS for creating a public digital card/profile with shareable link and QR code, optional contact saving (vCard), and optional buttons such as WhatsApp, payments (e.g., PayFast/SnapScan), booking links, social links and custom buttons. By creating an account or using the Service, you agree to these Terms.

You must be at least 18 years old and have the authority to bind any organization you represent. If you do not agree, do not use the Service.

• Free: core profile, unique link, QR code download, and online "Add to Contacts".
• Pro: everything in Free plus premium sections (e.g., WhatsApp button, payments via link, EFT/bank drawer, booking link, social links, custom links, custom handle, hide badge, company logo & header themes, Apple/Google Wallet pass).
• Lifetime: a once-off license including all current Pro features and future updates we release for the same product tier, with no monthly fees.

Feature lists above reflect how Linkza works today; we may improve, replace or retire features (see "Availability & Changes"). For current pricing, see the pricing page in-app.

• Subscriptions (Pro): Billed monthly in ZAR via our payment processor (PayFast). Your subscription renews automatically until cancelled. You can cancel at any time from your billing portal; cancellation stops future renewals, and access continues until the current paid period ends. We do not pro-rate or refund partial months.
• Taxes: Prices may include VAT where applicable; otherwise taxes are added as required by law.
• Downgrades: If you cancel or your payment fails, your account may be moved to Free. Pro-only sections will be disabled and hidden until you re-activate.
• Upgrades: You may upgrade from Free to Pro, or from Pro to Lifetime (we may cancel your Pro renewal before sending you to Lifetime checkout so you are not double-charged).
• Disputes: Please contact us before filing a chargeback; we can usually resolve billing issues quickly.

"Lifetime" refers to the lifetime of the Linkza product, not your personal lifetime. It is a non-transferable, non-exclusive license to use Linkza for as long as we continue to offer and support the product. It includes updates and improvements we release for this product tier at no additional charge. We reserve the right to discontinue the Service at any time. If discontinued, Lifetime licenses end with the Service and no refunds are due.

• Refund window: We offer a 7-day cooling-off window for first-time Lifetime purchases if you are unsatisfied. After this window, Lifetime purchases are non-refundable.
• Fair use: We may impose reasonable limits (e.g., API/QR generation rate limits, storage/bandwidth caps, or anti-abuse protections) to keep the service reliable for all users.
• Product scope: Lifetime does not guarantee new standalone products, separate modules, or enterprise add-ons unless explicitly stated.

During our beta testing period, we provide lifetime access codes to selected beta testers. These codes are intended for individual use and are subject to the following restrictions:

• One account per beta tester: Each beta tester is entitled to create only one account using their beta access code. Multiple accounts from the same beta tester (identified by email domain, phone number, or other identifying information) are not permitted.
• Account detection and enforcement: We monitor for multiple accounts from the same beta tester. If we detect multiple accounts created by the same beta tester, all associated accounts will be automatically disabled without notice.
• No appeals process: Decisions to disable accounts due to multiple beta tester accounts are final and not subject to appeal. This is to ensure fair access for all beta testers.
• Beta tester identification: We may use various methods to identify beta testers, including but not limited to email domains, phone numbers, IP addresses, and other identifying information to prevent abuse.
• Code sharing prohibition: Beta access codes are non-transferable and must not be shared with others. Sharing codes may result in all associated accounts being disabled.

By participating in our beta testing program, you agree to these restrictions and acknowledge that violating them may result in account termination.

• Do not upload or link to unlawful, infringing, defamatory, hateful, harassing, deceptive, malicious, or pornographic content.
• Do not send spam, phishing, or any unsolicited communications using links created in Linkza.
• Do not attempt to bypass security, scrape at scale, or interfere with our systems or other users.
• Respect intellectual property rights; only upload content you own or have permission to use.
• Do not misuse payments features (e.g., false claims, money laundering, donations without authorization).

We may remove content or suspend accounts that breach this AUP.

You retain ownership of content you provide (e.g., names, logos, images, links). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit your content as needed to operate the Service and show your public card. You represent that you have all rights to the content you submit and that it complies with the AUP.

We may display "Made with Linkza" branding on Free plans. Pro/Lifetime users may hide this branding where the UI allows.

• Payment processing: Card/bank details are handled by our payment partner (PayFast). We do not store full card numbers. Use of third-party services is subject to their terms and privacy policies.
• Payment links: Buttons such as PayFast or SnapScan simply link out to external payment pages you configure. We are not a payment provider and do not hold funds on your behalf.
• Wallet passes: Apple Wallet and Google Wallet are third-party platforms. We cannot guarantee compatibility across all devices, OS versions, or scanners.
• External links: Your card may include links to third-party sites. We are not responsible for those sites' content, availability, or security.

We strive to keep Linkza fast and reliable, but uptime is not guaranteed. Maintenance, incidents or provider outages may interrupt the Service. We may introduce, modify, or discontinue features at any time, including for security, technical, or business reasons. We may release beta/experimental features; these are provided "as is" and may change without notice. We are not responsible for delays, failures, or data loss caused by third-party providers, ISPs, or force majeure events.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid to us in the 12 months before the event giving rise to the claim, or ZAR 1,000 (one thousand), whichever is less. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption.

You may stop using the Service at any time and cancel paid plans as described in Billing. We may suspend or terminate your account (with or without notice) if you materially breach these Terms, including the AUP, or if required by law or to protect the Service or others. Upon termination, your license to use the Service ends. Some sections (e.g., liability limits, IP, governing law) survive termination.

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in that country for any dispute not subject to arbitration or small-claims procedures.

We process personal information in accordance with applicable data protection laws (including POPIA in South Africa, and where applicable, GDPR). See our Privacy Policy for details on what we collect, how we use it, and your rights. By using the Service, you consent to such processing.
